Code of Conduct/Media Waiver/Helmet Policy/Liability Waiver


Code of Conduct: Ensures that everyone has a positive learning experience. All participants – sailors, parents/guardians, and staff – shall respect the individual rights, safety, and property of others. Parents: please review these rules with your child.

I WILL:

  • be mindful of my instructors and respect their requests and follow their directions
  • respect the differences in other people, make an effort to include everyone, and refrain from behavior that may hurt another sailor or staff member’s feelings
  • wear closed-toed shoes at all times
  • be kind to my fellow sailors and instructors
  • respect other people’s property
  • let my instructor know if I am or I am not having a good time
  • have fun at CSC in ways that are safe to others and myself
  • have a positive attitude and an open mind towards learning something new and exciting!

I WILL NOT:

  • fight with other sailors with my hands or my words
  • go anywhere without the permission of my instructors
  • use derogatory terms or offensive language
  • tease or bully other sailors
  • bring inappropriate items (includes electronics, weapons, drugs, etc) to CSC

If I choose not to follow this Code of Conduct:

  • First time: I will be given a verbal warning explaining problem and the expected behavior.
  • Second time: I will be removed from the activity and my parent will be called; the Program Director may call home to discuss a behavior plan.
  • Third time: The Program Director will be notified and my parents will be called to pick me up.

Media Waiver: Students and participants agree to allow CSC to use photographs or videos of them for any CSC promotional materials.

Helmet Policy: It is the standard practice of the Clinton Sailing Club (CSC) to require students, instructors, volunteers, and anyone on board a CSC sailboat to wear a helmet supplied by CSC. If you would like to opt out of this requirement and assume all responsibility for you or your minor child, please check the appropriate button, read the helmet waiver statement, and sign below. The instructors will not have the ability accept helmet waivers during the program.

LIABILITY WAIVER, RELEASE AND INDEMNITY AGREEMENT (“AGREEMENT”)

For and in consideration of Clinton Sailing Club, Inc. (the “Organization”) allowing me, the undersigned, to participate in any capacity in a Organization sanctioned, licensed, or approved event or activity (“Event” or “Events”); I, for myself, and on behalf of my spouse, children, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors, and assigns, hereby agree to and make the following contractual representations pursuant to this Agreement (the “Agreement”):

  1. RULES AND REGULATIONS: I hereby agree to abide by the rules, regulations, and policies of the Organization, including any and all COVID-19 related safety measures required by the Organization.
  2. ACKNOWLEDGMENT OF RISK: I knowingly, willingly, and voluntarily acknowledge the inherent risks associated with the sport of sailing, and that participation in any Organization involves risks and dangers including, without limitation, the potential for serious bodily injury (including broken bones, head or neck injuries), sickness and disease (including communicable diseases such as COVID-19), trauma, pain & suffering, permanent disability, paralysis and death; loss of or damage to personal property; exposure to extreme conditions and circumstances; accidents involving other participants, event staff, volunteers or spectators; contact or collision with other participants or natural or manmade objects; adverse weather conditions; facilities issues and premises conditions; failure of protective equipment; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Event organizers and competition management; and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”).
  3. ASSUMPTION OF RISK: I understand that the aforementioned Risks may be caused in whole or in part or result directly or indirectly from the negligence of my own actions or inactions, the actions or inactions of others participating in the Events, or the negligent acts or omissions of the Released Parties defined below, and I hereby voluntarily and knowingly assume all such Risks and responsibility for any damages, liabilities, losses, or expenses that I incur as a result of my participation in any Events. I also agree to be responsible for any injury or damage caused by me or any agents under my direction and control at any Event.
  4. RELEASE AND INDEMNITY: In consideration of my participation in any Event, I hereby release from liability and waive any claims against the owner or organizer of the Event, its licensees, competition managers, promoters, sponsors, advertisers, beneficiaries, venue providers, and supporting organizations, together with the officers, directors, employees, volunteers and contractors of them (the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss, or expense (including court costs and reasonable attorney fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Events, including claims for Liability caused in whole or in part by the negligent acts or omissions of the Released Parties. Further, I agree to indemnify, defend, and hold harmless the Released Parties and Event Organizers against and from any and all Liability imposed on, incurred by, or asserted against any Released Party or Event Organizer resulting from, arising out of, in connection with, or relating to my breach of this Agreement.
  5. COMPLETE AGREEMENT AND SEVERABILITY CLAUSE: This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
  6. Releasors agree that this Agreement shall be governed by federal maritime law and that any claim brought by the Participant and/ or the Participant’s Guardian against CSC shall be adjudicated in the United States District Court, District of Connecticut. All other claims or disputes arising out of the Agreement that are not under the District Court’s jurisdiction shall be adjudicated in the courts located in Middlesex County, Connecticut. Should any provision of this Agreement be held by any such court to be illegal, invalid, or unenforceable for any reason, then the remaining portions of this Agreement will nonetheless remain in full force and effect, unless such portion of the Agreement is so material that its deletion would violate the obvious purpose and intent of the Parties.

I HAVE CAREFULLY READ THIS DOCUMENT IN ITS ENTIRETY, UNDERSTAND ALL OF ITS TERMS AND CONDITIONS, AND KNOW IT CONTAINS AN ASSUMPTION OF RISK, RELEASE, WAIVER FROM LIABILITY, AND INDEMNIFICATION.

By signing below, I (as the participant or as the Parent/Legal Guardian of the minor identified below) hereby accept and agree to the terms and conditions of this Agreement in connection with my (or the minor’s) participation in any Event.
